2. Acceptance of Terms

By accessing this website and submitting designs to our Program (The Omnitude), you agree to comply with these Terms. If you disagree, please do not use this website.

3. Eligibility

• Users must be 18 years or older, or have parental consent to submit designs. Parental consent is legally acceptable under EU laws (e.g., GDPR) for minors.
• Submitters confirm they own the rights to submitted designs and can legally submit them.

4. Submitting Designs

• Designs may be submitted through the designated process on our website.
• You retain ownership of your submitted designs.
• By submitting, you grant us a non-exclusive, worldwide, royalty-free license to use the designs for review, marketing, and selection purposes, including in posts and promotional content.
• If a design is selected for production and distribution, we may request an exclusive license for a specified period under separate agreement.

5. Commissions and Sales

• If selected, designers receive commissions as outlined in the Program guidelines.
• Commissions typically range between 5% and 15% of the retail price, depending on contributor count and significance.
• Contributors' names will be prominently displayed per product and collection.
• Payments are processed quarterly after each sales period and include a breakdown of sales, returns, and commission amounts.
• Further details, including any special agreements, are communicated via private contracts.

6. Selection Process

• Designs are reviewed for originality, quality, and alignment with brand standards.
• We reserve the right to reject submissions without explanation.

7. Intellectual Property

• Designers guarantee submissions do not infringe third-party rights.
• OmnitudeDesign is indemnified against any third-party copyright-infringement claims.

8. Changes to Terms

We may update these Terms at any time. Continued use of the website implies acceptance of updates.

9. Termination

We may terminate or suspend your access to the Program at any time without notice.

10. Governing Law

These Terms are governed by Dutch law, and any disputes fall under the jurisdiction of Dutch courts.
